No Win, No Fee Debt Collection: How It Works

"No win, no fee" is the standard commercial model for debt collection agencies in the UK, and it's a big part of why using one is such a low-risk way to chase an overdue invoice. Here's exactly how it works, and what to check before you sign up with any agency.

What "no win, no fee" actually means

Under a no win, no fee (also called contingency or success-fee) model, the agency takes on your debt with no upfront charge. They only get paid if they successfully recover money from the debtor, and their fee is a pre-agreed percentage of whatever is actually collected. If nothing is recovered, you owe nothing — the agency has absorbed the cost of the work themselves.

How the commission is typically structured

Commission rates vary by agency, the age and size of the debt, and how many stages of recovery are needed. As a rough guide, fresher, smaller debts tend to attract a lower percentage, while older, harder-to-collect debts (or ones requiring more intensive pursuit) attract a higher one, sometimes on a sliding scale — the older a debt, the harder it typically is to recover, which is reflected in the fee.

What's not included

No win, no fee usually covers the core recovery process — contacting the debtor, negotiating, sending formal demands. It typically doesn't cover third-party legal costs if a case genuinely needs to go to court (issuing a claim, solicitor's fees for a contested hearing) — those are usually agreed and quoted separately, and a good agency will always tell you clearly before any cost like that is incurred, so you can decide whether it's worth pursuing further.

Why it's low risk for creditors

  • No upfront fees, so there's no financial exposure in trying
  • The agency is financially motivated to actually recover the debt, not just go through the motions
  • You only pay a percentage of money you've actually received — the debt is never worse off than before
  • It removes the internal time cost of chasing the debt yourself

Questions to ask before instructing an agency

  1. What percentage is charged, and does it vary by debt age/size?
  2. Are there any circumstances where I'd owe a fee even if nothing is recovered?
  3. What happens if legal action becomes necessary — is that included or separate, and is it my decision?
  4. How will you contact my customer, and how does that reflect on my business?
  5. How quickly do you typically get a first response from a debtor?
